These Terms & Conditions govern the use of Toletwala.com and the Toletwala Android application. By accessing or using our platform, you agree to be bound by these terms.
1. Acceptance of Terms
By accessing Toletwala.com or using the Toletwala mobile application, you acknowledge that you have read, understood, and agree to comply with these Terms & Conditions. If you do not agree, you must not use the platform.
2. Platform Description
Toletwala is an online property listing platform that connects property owners, tenants, and seekers. We do not act as a broker, agent, or guarantor for any property transaction.
3. User Eligibility
You must be at least 18 years of age to use Toletwala. By using the platform, you represent that you are legally capable of entering into a binding agreement under Indian law.
4. User Accounts
Users are responsible for maintaining the confidentiality of their login credentials and for all activities that occur under their account. Toletwala reserves the right to suspend or terminate accounts violating these terms.
5. Property Listings
Property owners are solely responsible for the accuracy, legality, and authenticity of listings posted on Toletwala. Toletwala does not verify ownership or guarantee the availability, pricing, or condition of any property.
6. Property Listing Validity, Auto-Expiration & Relisting Policy
a) Any property listed on Toletwala.com or the Toletwala Android application is subject to a fixed listing validity period. Any property listed on the platform shall be automatically considered as “Rented”, “Expired”, or “Inactive” after 45 (forty-five) days from the original date of listing, irrespective of whether the property has actually been rented or whether the owner has updated the listing status.
b) On completion of the 45-day listing period: the property shall be removed from active search results and marked as expired or inactive. The listing shall no longer be available for tenant enquiries unless renewed or relisted. From the 46th (forty-sixth) day onwards, the property owner may relist or rent out the same property again on the platform by creating a new listing or renewing the expired listing, subject to applicable listing fees and prevailing platform policies.
c) Toletwala does not verify, guarantee, or take responsibility for the actual rental transaction, agreement, payment, or occupancy status between property owners and tenants. Property owners are solely responsible for updating the property status if rented before the 45-day period, and/or relisting or renewing the property if the property remains available after expiration.
d) Any fees paid for property listings, premium features, or promotional services are non-refundable and non-transferable, regardless of whether the property is rented before or after the 45-day validity period.
e) Toletwala reserves the right to modify, extend, shorten, suspend, or discontinue listing validity periods, relisting rules, fees, or platform features at its sole discretion, with or without prior notice.
7. Payments & Fees
Certain features may be offered free of charge, while others may require payment. All fees, once paid, are non-refundable unless explicitly stated otherwise.
8. Prohibited Activities
Users must not post false, misleading, or illegal content, misuse contact information, engage in fraud, scrape data, or attempt to disrupt the platform’s functionality.
9. Third-Party Services
Toletwala may integrate third-party tools or services. We are not responsible for the content, policies, or practices of any third-party service.
10. Limitation of Liability
Toletwala shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of the platform, including disputes between users.
11. Indemnification
You agree to indemnify and hold harmless Toletwala, its founders, employees, and partners from any claims, damages, or losses arising from your use of the platform or violation of these terms.
12. Termination
Toletwala reserves the right to suspend or terminate access to the platform at any time without prior notice if these Terms & Conditions are violated.
13. Governing Law
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of Indian courts.
14. Changes to Terms
Toletwala may update these Terms & Conditions at any time. Continued use of the platform constitutes acceptance of the revised terms.
